demand package

You might see it as a letter from a lawyer or insurance adjuster with attachments like medical records, bills, wage-loss information, photos, and a dollar amount requested to settle a claim. A demand package is the set of materials sent to the other side to explain what happened, show the extent of the harm, and ask for payment. It usually includes a summary of the facts, proof of damages, and a deadline for a response.

In practice, a strong demand package can shape settlement talks early. After a crash, workplace incident, or other injury, it gives the insurer or opposing party something concrete to evaluate instead of guessing at the value of the claim. For someone hurt in Idaho traffic involving farm or freight trucks, that can mean documenting not just emergency care but follow-up treatment, missed work, and how the injury affected day-to-day life. A good package often supports a later settlement, negotiation, or even a lawsuit if talks fail.

It can also affect timing. In Idaho, most personal injury claims are generally subject to a two-year deadline under Idaho Code § 5-219 (2024). Sending a demand package does not pause that statute of limitations. If the insurer delays or makes a low offer, waiting too long to file can weaken or even bar the claim.
